Terms of Service

1. Acceptance of Terms
Welcome to StreamPulse ("Service," "we," "us," or "our"). By accessing or using StreamPulse at streampulse.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
StreamPulse is operated by StreamPulse Pay, located in Indiana, United States.
2. Description of Service
StreamPulse is a payment aggregation dashboard that connects to your third-party payment platforms (Stripe, PayPal, Venmo, and bank accounts) to provide a unified view of your payment transactions.
Important Clarifications:
StreamPulse does not process, hold, or transfer funds
StreamPulse does not act as a payment processor or financial institution
StreamPulse provides read-only access to your payment data from connected platforms
All payment transactions are governed by the terms of your payment platform providers (Stripe, PayPal, Venmo, etc.)
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use StreamPulse. By registering, you represent that:
You meet the age requirement
All information you provide is accurate and current
You will maintain the accuracy of your information
3.2 Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Types
Free Plan: Limited to 2 connected payment platforms, basic features
Pro Plan: Unlimited platforms, advanced filtering, CSV export, priority support ($9/month)
4. Payment Platform Connections
4.1 OAuth Authorization
When you connect a payment platform (Stripe, PayPal, Venmo, bank), you authorize StreamPulse to:
Access read-only transaction data
Retrieve payment history, amounts, dates, and client information
Store aggregated payment data in our secure database
4.2 Permissions Granted
StreamPulse requests read-only permissions from your payment platforms. We cannot:
Initiate payments or transfers on your behalf
Modify your payment platform settings
Access your bank account credentials directly
Share your data with third parties (except as required by law)
4.3 Revoking Access
You may disconnect any payment platform at any time through your dashboard settings. Disconnecting a platform will:
Stop data synchronization immediately
Retain historical data for your reference (unless you request deletion)
5. User Responsibilities
You agree to:
Use the Service only for lawful purposes
Not use the Service to engage in fraudulent activities
Not attempt to reverse engineer, hack, or compromise our systems
Not scrape, copy, or extract data using automated tools
Comply with all applicable laws regarding tax reporting and financial record-keeping
6. Prohibited Conduct
You may not:
Share your account with others or create multiple accounts
Use the Service to monitor accounts you don't own or have authorization to access
Attempt to access other users' data
Upload malicious code, viruses, or harmful software
Interfere with the proper functioning of the Service
Use the Service in a way that could damage our reputation or violate third-party rights
Violation of these terms may result in immediate account suspension or termination.
7. Data Privacy and Security
7.1 Data Collection
We collect:
Account information (name, email, payment platform credentials via OAuth)
Payment transaction data (dates, amounts, client names, platforms)
Usage data (login times, features used, IP addresses)
7.2 Data Security
We implement industry-standard security measures:
SSL/TLS encryption for data transmission
Encrypted storage for sensitive data
Regular security audits and updates
Secure OAuth tokens (never storing raw credentials)
7.3 Data Retention
Active account data is retained indefinitely while your account is active
Deleted account data is permanently removed within 30 days of deletion request
Backup copies may exist for up to 90 days for disaster recovery
7.4 Data Sharing
We do not sell, rent, or share your payment data with third parties except:
To comply with legal obligations (subpoenas, court orders)
To enforce these Terms or protect our rights
With your explicit consent

8. Payment Terms
8.1 Pricing
Free Plan: $0/month (limited features)
Pro Plan: $9/month (billed monthly)
8.2 Billing
Subscriptions are billed monthly on the date you subscribe
Payment is processed via Stripe
All fees are non-refundable except as required by law
8.3 Cancellation
You may cancel your Pro subscription at any time through your account settings. Upon cancellation:
You retain access until the end of your current billing period
Your account reverts to the Free Plan
No partial refunds are provided for unused days
8.4 Price Changes
We may change pricing with 30 days' notice. Existing subscribers will be grandfathered at their current rate for 12 months.
9. Service Availability
9.1 Uptime
We strive for 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance will be announced 24 hours in advance when possible.
9.2 Service Modifications
We reserve the right to:
Modify or discontinue features with reasonable notice
Update our technology infrastructure
Add or remove supported payment platforms
9.3 Third-Party Dependency
Service functionality depends on third-party APIs (Stripe, PayPal, Venmo). We are not responsible for:
Downtime or changes to third-party APIs
Data inaccuracies from payment platforms
Loss of access due to third-party policy changes
10. Intellectual Property
10.1 Our Rights
StreamPulse owns all rights to:
The Service, website, and dashboard design
Our logo, brand, and trademarks
Software, algorithms, and proprietary technology
10.2 Your Rights
You retain ownership of your payment data. By using the Service, you grant us a limited license to:
Store and display your data in your dashboard
Aggregate anonymized data for service improvement (no personal information shared)
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including:
Merchantability, fitness for a particular purpose, non-infringement
Accuracy, reliability, or completeness of payment data
Uninterrupted or error-free service
Data Accuracy Disclaimer:
StreamPulse aggregates data from third-party platforms. We do not guarantee 100% accuracy. Always verify critical financial data with your original payment platforms.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Our total liability for any claim arising from your use of the Service is limited to the greater of (a) $100 or (b) the amount you paid us in the 12 months preceding the claim
We are not liable for indirect, incidental, consequential, or punitive damages
We are not liable for loss of profits, data, revenue, or business opportunities
We are not liable for damages caused by third-party platforms (Stripe, PayPal, Venmo)
13. Indemnification
You agree to indemnify and hold harmless StreamPulse, its officers, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from:
Your violation of these Terms
Your misuse of the Service
Your violation of third-party rights or laws
14. Termination
14.1 Your Right to Terminate
You may delete your account at any time through your account settings.
14.2 Our Right to Terminate
We may suspend or terminate your account if:
You violate these Terms
You engage in fraudulent or illegal activity
We are required to do so by law
We discontinue the Service
14.3 Effect of Termination
Upon termination:
Your access to the Service ends immediately
Your payment data is deleted within 30 days (unless retention is required by law)
You remain liable for any outstanding fees
15. Governing Law
These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law principles. Any disputes must be resolved in the courts of Vanderburgh County, Indiana.
16. Dispute Resolution
16.1 Informal Resolution
Before filing a lawsuit, you agree to contact us at streampulsepayments@protonmail.com to resolve the dispute informally.
16.2 Arbitration (Optional)
If informal resolution fails, disputes may be resolved through binding arbitration under the American Arbitration Association rules. Either party may opt for court proceedings instead.
16.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.
17. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via:
Email to your registered address
Notice in your dashboard
Updated "Last Updated" date at the top of this page
Continued use of the Service after changes constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

20. Entire Agreement
